The Family Law Act provides the legislative pathway for the preparation of separation agreements, cohabitation agreements and marriage contracts – colloquially referred to as “pre-nups”.

A Separation Agreement is a domestic contract between two people who have separated or divorced and wish to resolve all outstanding issues (except for a divorce) by way of negotiation and binding contract.

A Cohabitation Agreement is a domestic contract for people that are living together, but do not intend or have not yet married.

A Marriage Contract is a domestic contract for people who are married or who intend to marry.

In the event the parties separate, a Cohabitation Agreement or Marriage Contract will provide clear parameters around the issues of spousal support and the division of property.
